Clean Break Terms of Service

• Clean Break is a $3.99/week subscription with a 3-day free trial, billed by Apple and renewing automatically. Cancel any time in your Apple ID settings.
• Refunds are handled by Apple, not us.
• Clean Break helps with general wellness. It is not medical treatment and not a medical device.
• The money figures are illustrative examples to motivate you — not financial advice and not a guarantee of returns.
• We're a small company. We've capped our liability at what you paid us.

1. Acceptance of terms

By downloading, installing, or using the Clean Break iOS application (“Clean Break,” “the app”), you (“you,” “user”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not install or use the app.

These Terms form a binding contract between you and North Tumbleweed LLC (“we,” “us,” “our,” “the Company”), the publisher of Clean Break.

2. Eligibility — 18 and older

Clean Break is intended for adults 18 years of age or older. The app concerns quitting nicotine, an adult product. By using the app, you represent that you are at least 18 years of age.

On first launch, we confirm your age using Apple's Declared Age Range signal, with a one-time date-of-birth entry as a fallback. If you are under 18, you may not use Clean Break, and access is blocked. You may not use the app if you have been previously banned or are otherwise prohibited from using it under applicable law.

3. The service

Clean Break is a general-wellness app that helps adults quit nicotine. It provides (“the Service”):

• An onboarding quiz and a personalized, on-device “Money Reality Check” that estimates what your nicotine habit has cost and could cost
• A clean-day streak counter and a money-saved “goal ledger”
• A 60-second craving panic-button intervention
• A sourced health-recovery timeline
• An AI quit coach (selectable across four personalities) that adapts to your progress
• A compassionate slip mechanic that treats a relapse as data, not failure
• A Home Screen and Lock Screen widget showing your progress

The coach depends on third-party providers including Apple, Railway, Supabase, RevenueCat, and an AI service we use to generate coach replies. Outages or changes by these providers may affect the Service. We may modify, add, or remove features at any time, with or without notice.

6. Subscriptions and billing

6.1 Subscription model

Clean Break offers premium features through auto-renewing in-app subscriptions. Subscriptions are processed and managed entirely through Apple's App Store using StoreKit, with subscription state verified by RevenueCat.

There is one plan (subject to regional pricing in your local currency):

Clean Break starts with a 3-day free trial, then $3.99 per week, renewing automatically through your Apple ID. After the trial, a subscription is required to use the app's features; there is no separate free or limited tier. You are not charged until the free trial ends, and you can cancel before then to avoid any charge.

Pricing in your jurisdiction may vary based on Apple's local conversion. The app will always display the price you will be charged at the moment of purchase.

6.2 Auto-renewal

• After the 3-day free trial, the subscription automatically renews each week
• Your Apple ID account will be charged for renewal within 24 hours before the end of the current period
• Auto-renewal can be turned off at any time through your Apple ID Account Settings, but must be done at least 24 hours before the end of the current period to avoid the next charge

6.3 Free trial

Clean Break offers a 3-day free trial, after which the weekly subscription begins. The trial is subject to Apple's terms: trial eligibility is determined by Apple (typically, you may only use a free trial once per Apple ID per subscription group), and the unused portion of any free trial is forfeited if you purchase a subscription early. If you cancel at least 24 hours before the trial ends, you are not charged.

6.4 Cancellation

You may cancel your subscription at any time:

1. Open Settings on your iPhone
2. Tap your name → Subscriptions
3. Find “Clean Break” and tap Cancel Subscription

You can also reach this screen from within the app via Settings → Manage Subscription. Cancellation takes effect at the end of your current billing period. You retain access to premium features until then.

6.5 Refunds

Refunds are handled by Apple, not by us. We have no control over Apple's refund decisions and cannot issue refunds directly.

To request a refund:

• Visit reportaproblem.apple.com
• Or, in iOS: Settings → Apple ID → Subscriptions → Clean Break → Report a Problem

Apple will evaluate your request under their standard refund policy.

6.6 Price changes

We reserve the right to change subscription pricing. Price changes take effect at the start of the next billing period after notice. Apple will notify you of price changes and may require your explicit consent before renewing at a new price.

6.7 Promotional offers

We may offer promotional pricing or discounts at our discretion. These offers may be limited in time, geography, or eligibility. We are not obligated to extend any promotional offer or to honor an expired offer.

7. Acceptable use

You agree not to use Clean Break to:

• Violate any applicable law, regulation, or third-party right
• Generate, submit, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Reverse-engineer, decompile, disassemble, or attempt to extract source code from the app or its backend
• Circumvent, disable, or interfere with security-related features of the Service
• Use automated scripts, bots, or scrapers to access or interact with the app or its API
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• Resell, redistribute, sublicense, or otherwise commercialize access to the Service or any part of it
• Share your subscription with another person or use it in a way that exceeds reasonable personal use
• Use the Service in any way that exceeds the rate limits we have set, or attempt to bypass them

Violation of these terms may result in immediate termination of your access without refund.

8. AI coach and generated content

8.1 What the coach does

The Clean Break coach uses a third-party AI service to generate conversational support and general suggestions based on the progress information you share with it. It is a motivational tool, not a counselor, therapist, doctor, or financial advisor.

8.2 No guarantee of accuracy

AI-generated responses are produced automatically and may be inaccurate, incomplete, or inappropriate to your situation. They reflect patterns the underlying model learned from training data we did not produce. Do not rely on the coach for medical, psychological, legal, or financial decisions.

We make no warranty that:

• The coach's advice is appropriate to your specific situation
• The recommended actions will help you quit or produce any particular result
• The Service will be free of errors in its content

8.3 Your responsibility

You are solely responsible for how you use Clean Break and the information it provides. We are not liable for any actions you take based on the app's output, including any health, lifestyle, or financial choices.

9. Your content (answers, goals, conversations)

You retain ownership of the information you enter into Clean Break. The large majority of it — your quiz answers, quit plan, goals, slips, and check-ins — is stored on your device and synced privately through your own iCloud. Your coach conversation history is also stored on your device; your coach messages are sent to our backend solely to generate replies, as described in our Privacy Policy.

We do not claim ownership of AI-generated outputs produced in response to your messages. You may use them for personal purposes. We do not sell your coach messages and do not authorize them to be used to train AI models.

10. Intellectual property

10.1 Our property

All intellectual property rights in Clean Break — including the app code, design, graphics, icons, logos, the “Clean Break” name, the coach personalities and their voices, and all branding — are owned by North Tumbleweed LLC or our licensors.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Clean Break for your personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the app
• Use our trademarks, logos, or brand names without our prior written consent
• Create derivative works based on Clean Break or its content

10.2 Third-party property

The AI model that powers the coach is owned by its provider. We license access to it — we do not own it.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, secure, or free of malicious code
• Warranties regarding the accuracy, reliability, or completeness of any content, including AI-generated coaching and the illustrative money figures
• Warranties that the Service will help you quit nicotine or produce any particular health, behavioral, or financial outcome

We do not warrant that the Service will meet your expectations, be available at any specific time or location, or that defects will be corrected.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORTH TUMBLEWEED LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

This includes, but is not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Any financial loss or investment decision made in reliance on the app's illustrative money figures
• Any health or psychological impact related to quitting nicotine or using the app
• Damages resulting from lifestyle choices made based on the app's recommendations
• Loss of locally stored data following uninstallation, deletion, or device loss
• Any unauthorized access to or alteration of your data

Our total aggregate liability for all claims arising from your use of the Service shall not exceed the greater of (a) the amount you paid us in subscription fees during the twelve (12) months preceding the claim, or (b) fifty United States dollars (USD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, including incidental or consequential damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless North Tumbleweed LLC and its officers, directors, employees, and agents from any claim, liability, damage, loss, cost, or expense (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including but not limited to privacy or intellectual property rights
• Any content you create, submit, or share through the Service

14. Termination

14.1 By you

You may stop using Clean Break at any time. To fully terminate the relationship:

1. Cancel your subscription via Apple ID Settings (see Section 6.4)
2. Use “Delete all my data” in Settings if you want to erase your on-device data
3. Delete the app from your device

Uninstalling the app removes all locally stored data. Cancellation prevents future charges but does not refund prior charges.

14.2 By us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for any violation of these Terms.

Upon termination:

• Your license to use the Service is immediately revoked
• We may delete any server-side data associated with your anonymous identifier
• Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution survive termination

15. Governing law and dispute resolution

15.1 Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

15.2 Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for matters relating to intellectual property or unauthorized access to the Service.

15.3 Class-action waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

15.4 Fallback jurisdiction

If arbitration is found to be inapplicable or unenforceable, you agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

15.5 Time limit

Any claim arising from these Terms or your use of the Service must be brought within one (1) year after the cause of action arises. After that, the claim is permanently barred.

16. Changes to these Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the “Effective” and “Last updated” dates at the top
• For material changes, we will display an in-app notice before the change takes effect

If you do not agree to a change, your sole remedy is to stop using the Service. Continued use after a change constitutes acceptance of the updated Terms.

17. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and North Tumbleweed LLC regarding Clean Break.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
• Waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment. We may assign our rights and obligations under these Terms without your consent. You may not assign yours.
• Apple's terms. Your use of Clean Break is also subject to Apple's Licensed Application End User License Agreement. In the event of a conflict, Apple's terms govern your relationship with Apple as the distributor.
• Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, or third-party infrastructure failures.
