Clean Break Terms of Service

1. Acceptance of terms

By downloading, installing, or using the Clean Break iOS application (“Clean Break,” “the app”), you (“you,” “user”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not install or use the app.

These Terms form a binding contract between you and North Tumbleweed LLC (“we,” “us,” “our,” “the Company”), the publisher of Clean Break.

2. Eligibility — 18 and older

Clean Break is intended for adults 18 years of age or older. The app concerns quitting nicotine, an adult product. By using the app, you represent that you are at least 18 years of age.

On first launch, we confirm your age using Apple's Declared Age Range signal, with a one-time date-of-birth entry as a fallback. If you are under 18, you may not use Clean Break, and access is blocked. You may not use the app if you have been previously banned or are otherwise prohibited from using it under applicable law.

3. The service

Clean Break is a general-wellness app that helps adults quit nicotine. It provides (“the Service”):

The coach depends on third-party providers including Apple, Railway, Supabase, RevenueCat, and an AI service we use to generate coach replies. Outages or changes by these providers may affect the Service. We may modify, add, or remove features at any time, with or without notice.

4. Not medical treatment

Clean Break is a general-wellness and motivation app. It is not a medical device, not a substitute for professional medical care, and does not diagnose, treat, cure, or prevent any disease or condition, including nicotine dependence.

The health-recovery timeline, coach messages, and recommended actions are general educational and motivational content, not medical advice. Nicotine withdrawal can have real physical and psychological effects. If you have a medical condition, are pregnant, take medication, or have concerns about quitting, consult a qualified healthcare professional. In a medical or mental-health emergency, contact your local emergency number; in the U.S. you can call or text 988 (Suicide & Crisis Lifeline).

5. Money figures are illustrative — not financial advice

Every dollar amount Clean Break shows you — what nicotine has “burned,” what you could save, and any projection of future value — is an illustrative estimate calculated from the habit details you enter. These numbers exist to motivate you. They are not financial advice, not investment advice, and not a promise or guarantee of any financial outcome.

Projections of future value assume a hypothetical broad stock-market index fund returning an average of 11% per year (broadly in line with recent stock-market averages). This is a simplified, illustrative assumption. Real investments carry risk, can lose value, and do not deliver a fixed annual return. Past performance does not predict future results. The figures do not account for taxes, fees, inflation, or your personal circumstances.

Clean Break does not provide brokerage, advisory, or investment services, and does not move, hold, or manage any of your money. The “goal ledger” is a motivational tracker inside the app, not an actual account or transfer of funds. Before making any investment or financial decision, consult a qualified, licensed financial professional.

6. Subscriptions and billing

6.1 Subscription model

Clean Break offers premium features through auto-renewing in-app subscriptions. Subscriptions are processed and managed entirely through Apple's App Store using StoreKit, with subscription state verified by RevenueCat.

Clean Break starts with a 3-day free trial, then $3.99 per week, renewing automatically through your Apple ID. After the trial, a subscription is required to use the app's features; there is no separate free or limited tier. You are not charged until the free trial ends, and you can cancel before then to avoid any charge.

Pricing in your jurisdiction may vary based on Apple's local conversion. The app will always display the price you will be charged at the moment of purchase.

6.2 Auto-renewal

6.3 Free trial

Clean Break offers a 3-day free trial, after which the weekly subscription begins. The trial is subject to Apple's terms: trial eligibility is determined by Apple (typically, you may only use a free trial once per Apple ID per subscription group), and the unused portion of any free trial is forfeited if you purchase a subscription early. If you cancel at least 24 hours before the trial ends, you are not charged.

6.4 Cancellation

You may cancel your subscription at any time:

  1. Open Settings on your iPhone
  2. Tap your name → Subscriptions
  3. Find “Clean Break” and tap Cancel Subscription

You can also reach this screen from within the app via Settings → Manage Subscription. Cancellation takes effect at the end of your current billing period. You retain access to premium features until then.

6.5 Refunds

Refunds are handled by Apple, not by us. We have no control over Apple's refund decisions and cannot issue refunds directly.

To request a refund:

Apple will evaluate your request under their standard refund policy.

6.6 Price changes

We reserve the right to change subscription pricing. Price changes take effect at the start of the next billing period after notice. Apple will notify you of price changes and may require your explicit consent before renewing at a new price.

6.7 Promotional offers

We may offer promotional pricing or discounts at our discretion. These offers may be limited in time, geography, or eligibility. We are not obligated to extend any promotional offer or to honor an expired offer.

You agree not to use Clean Break to:

Violation of these terms may result in immediate termination of your access without refund.

8. AI coach and generated content

8.1 What the coach does

The Clean Break coach uses a third-party AI service to generate conversational support and general suggestions based on the progress information you share with it. It is a motivational tool, not a counselor, therapist, doctor, or financial advisor.

8.2 No guarantee of accuracy

AI-generated responses are produced automatically and may be inaccurate, incomplete, or inappropriate to your situation. They reflect patterns the underlying model learned from training data we did not produce. Do not rely on the coach for medical, psychological, legal, or financial decisions.

We make no warranty that:

8.3 Your responsibility

You are solely responsible for how you use Clean Break and the information it provides. We are not liable for any actions you take based on the app's output, including any health, lifestyle, or financial choices.

9. Your content (answers, goals, conversations)

You retain ownership of the information you enter into Clean Break. The large majority of it — your quiz answers, quit plan, goals, slips, and check-ins — is stored on your device and synced privately through your own iCloud. Your coach conversation history is also stored on your device; your coach messages are sent to our backend solely to generate replies, as described in our Privacy Policy.

We do not claim ownership of AI-generated outputs produced in response to your messages. You may use them for personal purposes. We do not sell your coach messages and do not authorize them to be used to train AI models.

10. Intellectual property

10.1 Our property

All intellectual property rights in Clean Break — including the app code, design, graphics, icons, logos, the “Clean Break” name, the coach personalities and their voices, and all branding — are owned by North Tumbleweed LLC or our licensors.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Clean Break for your personal, non-commercial purposes, subject to these Terms.

You may not:

The AI model that powers the coach is owned by its provider. We license access to it — we do not own it.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

We do not warrant that the Service will meet your expectations, be available at any specific time or location, or that defects will be corrected.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORTH TUMBLEWEED LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

This includes, but is not limited to:

Our total aggregate liability for all claims arising from your use of the Service shall not exceed the greater of (a) the amount you paid us in subscription fees during the twelve (12) months preceding the claim, or (b) fifty United States dollars (USD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, including incidental or consequential damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless North Tumbleweed LLC and its officers, directors, employees, and agents from any claim, liability, damage, loss, cost, or expense (including reasonable attorneys' fees) arising from:

14.1 By you

You may stop using Clean Break at any time. To fully terminate the relationship:

  1. Cancel your subscription via Apple ID Settings (see Section 6.4)
  2. Use “Delete all my data” in Settings if you want to erase your on-device data
  3. Delete the app from your device

Uninstalling the app removes all locally stored data. Cancellation prevents future charges but does not refund prior charges.

14.2 By us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for any violation of these Terms.

15. Governing law and dispute resolution

15.1 Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

15.2 Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for matters relating to intellectual property or unauthorized access to the Service.

15.3 Class-action waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

15.4 Fallback jurisdiction

If arbitration is found to be inapplicable or unenforceable, you agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

15.5 Time limit

Any claim arising from these Terms or your use of the Service must be brought within one (1) year after the cause of action arises. After that, the claim is permanently barred.

16. Changes to these Terms

We reserve the right to modify these Terms at any time. When we make changes:

If you do not agree to a change, your sole remedy is to stop using the Service. Continued use after a change constitutes acceptance of the updated Terms.
